Treasury Issues Proposed Rule Providing Guidance on Incentives for US Production of Renewable Energy Components

On December 14, 2023, Treasury issued a proposed rule to clarify eligibility for the IRC section 45X Advanced Manufacturing Production tax credit established by section 13502 of the IRA. The credit incentivizes the US production of wind, solar, and battery components. The proposed rule clarifies definitions and confirms credit amounts for eligible components, including solar and wind components, inverters, battery components, and critical minerals. The guidance proposes definitions of terms to incentivize the US production of components and includes provisions to prevent potential fraud and abuse. Treasury will take public comment on the proposed rule for 60 days.
