Section 60102 of the IRA amends the Clean Air Act to add a new section 133. Section 133 appropriates $2.25 billion to the EPA Administrator to award grants and rebates to eligible entities for climate action planning, as well as permitting, purchase, and installation of zero-emission port technologies. Section 133 also appropriates an additional $750 million to the EPA Administrator to make grants and awards to eligible entities for these activities in air quality nonattainment areas. The entities eligible for grants under section 133 include port authorities; state, local, regional, and tribal agencies with jurisdiction over ports; air pollution control agencies; and private entities that own, operate, or use port facilities. The appropriated funds will remain available until September 30, 2027.

As of October 2024, EPA had awarded likely all of the $3 billion under this provision. In October 2024, EPA announced the selection of 55 applicants across 27 states and territories to receive nearly $3 billion through EPA’s Clean Ports Program. The grants will support the deployment of zero-emission equipment, as well as infrastructure and climate and air quality planning projects at ports across the country.
