IRA Section 60112 – Environmental Product Declaration Program

Section 60112 of the IRA appropriates $250 million to the EPA Administrator to develop and carry out a program related to environmental product declarations for construction materials and products. The program must “support the development, enhanced standardization and transparency, and reporting criteria for environmental product declarations that include measurements of the embodied greenhouse gas emissions of the material or product.” EPA may use funds appropriated for the program to provide grants and technical assistance to businesses that manufacture construction materials and products for developing and verifying environmental product declarations, as well as to states Indian tribes, and nonprofit organizations that support those businesses. The appropriated funds will remain available until September 30, 2031.

Section 60011 of the One Big Beautiful Bill Act of 2025 (Public Law 119-21) rescinded unobligated funds under this IRA provision.

Section 60112 of the IRA appropriates $250 million to EPA to develop and carry out a program related to environmental product declarations for construction materials and products to be used by September 30, 2031.

EPA has awarded $160 million in grants. The remaining $90 million in funds have not been awarded. In July 2024, EPA announced 38 grant recipients across the country, totaling nearly $160 million, to support efforts to report and reduce climate pollution from the manufacturing of construction materials and products. EPA estimates that the construction materials used in buildings and other built infrastructure account for more than 15% of annual global greenhouse gas emissions.

Litigation:

In Building Materials Re-Use Association v. EPA (filed July 31, 2025), Building Materials Re-Use Association sued EPA for terminating the program authorized by IRA section 60112 and a grant award made under the program.
