IRA Section 50144 – Energy Infrastructure Repurposing and Remediation Financing

Section 50144 of the IRA appropriates $5 billion to DOE to provide loan guarantees for projects that “retool, re-power, repurpose, or replace energy infrastructure that has ceased operations,” including projects that “include the remediation of environmental damage associated with energy infrastructure.” Where such project involve installing electricity generating equipment that uses fossil fuels, that equipment must “have controls or technologies to avoid, reduce, utilize, or sequester air pollutants and anthropogenic emissions of greenhouse gases.”

DOE may also use the appropriated funds to make guarantees for projects that “enable operating energy infrastructure to avoid, reduce, utilize, or sequester air pollutants or anthropogenic emissions of greenhouse gases.”

The funds appropriated under section 50144 will remain available through September 30, 2026.

Section 50402 of the One Big Beautiful Bill Act of 2025 (Public Law 119-21) rescinded unobligated funds under this IRA provision. Section 50403 of the One Big Beautiful Bill Act amended subsection (b) of the provision.

IRA appropriates $5 billion to DOE to provide loan guarantees to be used by September 30, 2026. DOE has announced conditional commitments for loan guarantees to 4 projects totaling more than the $5 billion appropriated.

In September 2024, DOE announced a conditional commitment to providing Wabash Valley Resources with a $1.559 billion loan guarantee to repurpose an industrial gasifier. In October 2024, DOE announced $860 million loan guarantee to a project in Puerto Rico. In December 2024, DOE announced a conditional commitment to provide a $2.5 billion loan guarantee to Wisconsin Electric Power Company and a $15 billion loan guarantee to PG&E, which closed in January 2025.
